I. Scope

1 These terms and conditions of business apply to contracts for the rental of hotel rooms for lodging purposes as well as all other services and deliveries provided by the Hotel Allgäuer Berghof for the customer.

2. the subletting or further leasing of the rooms provided and their use for purposes other than accommodation require the prior written consent of Hotel Allgäuer Berghof. The customer's terms and conditions shall only apply if this has been agreed in advance.

II Conclusion of Contract, Contract Partner; Statute of Limitations

1. with the booking, which can be made verbally, in writing, by telephone, fax or e-mail, the customer makes a binding offer to conclude an accommodation contract. The accommodation contract comes into effect with the booking confirmation by the Hotel Allgäuer Berghof.

2. On conclusion of the contract the customer shall sign the booking confirmation and return it to the Hotel Allgäuer Berghof. The amounts for down payment and balance payment are stated in the booking confirmation. Payment is made by bank transfer.

3. the contractual partners are the Hotel Allgäuer Berghof and the customer. If a third party has placed an order on behalf of the customer, the customer is liable to Hotel Allgäuer Berghof for all obligations arising from the hotel accommodation contract, provided that Hotel Allgäuer Berghof has a corresponding declaration from the third party.

4.  Insofar as the Hotel Allgäuer Berghof provides services within the framework of the contractual relationship, any claims due to defects shall become time-barred one year after the start of the statutory period of limitation; for all other claims of the customer the period of limitation shall be 6 months. The foregoing shall not apply in the event of liability of the hotel for damages arising from injury to life, body or health or liability for other damages based on an intentional or grossly negligent breach of duty by the Hotel Allgäuer Berghof, its legal representative or vicarious agent; in such cases the statutory limitation periods shall apply.

III Performance, Prices, Payment, Offsetting

1.  The Hotel Allgäuer Berghof is obliged to keep the rooms booked by the customer ready and to provide the agreed services.

2.   the customer is obliged to pay the Hotel Allgäuer Berghof's applicable or agreed prices for the room and the other services used by him. This also applies to services and expenses of the Hotel Allgäuer Berghof to third parties arranged by the customer.

3.  The agreed prices include the statutory value added tax valid at the time of booking. Should the statutory value added tax be increased between the time of booking and the start of the journey, the price of the journey shall be increased accordingly.

4.  If the period between conclusion and fulfilment of the contract exceeds 4 months and if the price generally charged by Hotel Allgäuer Berghof for such services increases, Hotel Allgäuer Berghof may raise the contractually agreed price appropriately, but by no more than 10%.

5.  the prices can also be changed by Hotel Allgäuer Berghof if the customer subsequently wishes to make changes to the number of rooms booked, the services of Hotel Allgäuer Berghof or the length of stay of guests and Hotel Allgäuer Berghof agrees to this.

6.  hotel Allgäuer Berghof invoices without a due date are payable within 10 days of receipt of the invoice without deduction. The Hotel Allgäuer Berghof is entitled to make accrued claims due at any time and to demand immediate payment. In the event of late payment, Hotel Allgäuer Berghof is entitled to charge interest on arrears in accordance with § 288 BGB. The right to assert further damages is reserved.

IV. Withdrawal of the customer (cancellation, rescission)

1.  a withdrawal by the customer from the contract concluded with Hotel Allgäuer Berghof requires the written consent of Hotel Allgäuer Berghof. If this does not take place, the agreed price from the contract must be paid even if the customer does not make use of contractual services. This shall not apply in cases of default in performance on the part of Hotel Allgäuer Berghof or in the event of impossibility of performance for which it is responsible.

2.  If a date for withdrawal from the contract has been agreed in writing between the Hotel Allgäuer Berghof and the customer, the customer may withdraw from the contract up to that date without triggering payment or damage compensation claims by the Hotel Allgäuer Berghof. The customer's right of rescission shall lapse if he does not exercise his right to rescind the contract by the agreed date.

to withdraw from the contract in writing to the Hotel Allgäuer Berghof, unless there is a case of default in performance by the Hotel Allgäuer Berghof or an impossibility of performance for which it is responsible.

In the case of rooms not used by the customer, the Hotel Allgäuer Berghof must set off the income from renting the rooms to others and the expenses saved.

3.  Hotel Allgäuer Berghof is at liberty to make a lump-sum payment for the damage incurred and to be compensated by the customer. The customer is then obliged to pay 80% for half-board or all-inclusive arrangements (without alcoholic beverages). The customer is at liberty to prove that no damage has been incurred or that the damage incurred by Hotel Allgäuer Berghof is less than the flat rate demanded.

V. Rescission of the Hotel Allgäuer Berghof

1. insofar as the customer's right of withdrawal has been agreed in writing within a certain period of time, the Hotel Allgäuer Berghof is entitled for its part to withdraw from the contract during this period if there are inquiries from other customers regarding the contractually booked rooms and the customer does not waive his right of withdrawal at the hotel's request. If an agreed advance payment is not made even after a reasonable grace period set by the Hotel Allgäuer Berghof with the threat of refusal has expired, the Hotel Allgäuer Berghof is likewise entitled to withdraw from the contract.

2. furthermore, the Hotel Allgäuer Berghof is entitled to withdraw from the contract extraordinarily for objectively justified reasons, for example if

- force majeure or other circumstances for which the Hotel Allgäuer Berghof is not responsible make it impossible to fulfil the contract

- rooms are booked under misleading or false information of essential facts, e.g. in the person of the customer or the purpose;

- the Hotel Allgäuer Berghof has reasonable cause to believe that the use of the hotel services may jeopardise the smooth running of the business, the security or the public reputation of the Hotel Allgäuer Berghof, without this being attributable to the sphere of control or organisation of the Hotel Allgäuer Berghof

3. the Hotel Allgäuer Berghof must inform the customer immediately of the exercise of the right of withdrawal and reimburse the contractual partner's consideration.

4. the organizer shall have no claim for damages against Hotel Allgäuer Berghof, except in the case of wilful or grossly negligent conduct on the part of Hotel Allgäuer Berghof, its legal representative or vicarious agent.

VI. room provision, handover and return

1.the customer does not acquire a claim to the provision of certain rooms, unless this claim is explicitly mentioned in the booking confirmation.

2. booked rooms are available to the customer from 16.00 hours on the agreed day of arrival. The customer has no claim to earlier provision.

3. on the agreed day of departure the rooms must be vacated and made available to the Hotel Allgäuer Berghof by 11.00 a.m. at the latest. Thereafter, Hotel Allgäuer Berghof may charge 50% of the full list price for the additional use of the room until 6 p.m. in addition to the damage incurred by Hotel Allgäuer Berghof, and 100% from 6 p.m. onwards. The customer is at liberty to prove to Hotel Allgäuer Berghof that it has suffered no damage or significantly less damage.

VII Liability of the Hotel Allgäuer Berghof

1. The Hotel Allgäuer Berghof is liable for its obligations under the contract with the due care of a prudent businessman. Liability, insofar as it is not a matter of essential contractual obligations (cardinal obligations) in the area typical of the service, is limited to damages that are attributable to intent or gross negligence on the part of the hotel, its legal representative or vicarious agent; this does not apply in the case of liability for damages arising from injury to life, body or health. Should disruptions or defects occur in the services provided by Hotel Allgäuer Berghof, Hotel Allgäuer Berghof will endeavour to remedy them as soon as it becomes aware of them or upon immediate notification of the customer. The customer is obliged to do what is reasonable for him in order to remedy the disturbance and to keep possible damage to a minimum.

2. The Hotel Allgäuer Berghof is liable to the customer for items brought to the hotel in accordance with the statutory provisions, i.e. up to one hundred times the room rate, for one day, up to a maximum of € 3,500, and for money and valuables up to € 800. Money and valuables may be stored in the hotel safe or room safe up to a maximum value of € 5,000; in this case the maximum liability limits stated in the previous sentence do not apply. The Hotel Allgäuer Berghof recommends making use of this possibility. Liability claims expire if the customer does not notify Hotel Allgäuer Berghof immediately after becoming aware of loss, destruction or damage (§ 703 BGB).

3.  the statutory provisions shall apply for unlimited liability of the Allgäuer Berghof.

4.  insofar as the customer is provided with a parking space in the hotel garage or in a hotel parking lot, even against payment, this does not constitute a safekeeping agreement. The Hotel Allgäuer Berghof shall not be liable for loss of or damage to motor vehicles parked or manoeuvred on the hotel property or their contents, except in cases of intent or gross negligence. This also applies to the Hotel Allgäuer Berghof's vicarious agents.

5.  wake-up orders are carried out by Hotel Allgäuer Berghof with the utmost care. Claims for damages, except in cases of gross negligence or intent, are excluded.

6.  messages, mail and goods consignments for guests are handled with care. Hotel Allgäuer Berghof will take care of the delivery, storage and - if desired - forwarding of the same for a fee. Claims for damages, except for gross negligence or intent, are excluded.

Arrival by car

From the direction of Stuttgart and Munich, take the exit off the A7 at Kempten. Then take the B19 towards Oberstdorf and exit at Blaichach on to the OA5 towards Blaichach. Just after Blaichach, turn right at the junction towards Gunzesried and continue up the windy road. Just before you reach Gunzesried, turn left on to the Allgäuer Berghof Panoramastraße (hotel guests have free access). After about 3.5km, you’ll see the Allgäuer Berghof hotel. If you’re visiting between October and April, you’ll need to use snow chains on your tyres.

If you are using a sat nav: Please add the destination Gunzesried, which is a district of Blaichach. Activate the sat nav to allow toll roads so that it takes you via the Berghof toll road. If your sat nav doesn’t recognise Alpe Eck 2, please put in the alternative address of Kapf 9 and follow the toll road up to the hotel. Don’t put in Ofterschwang as a destination because there’s no direct access from Ofterschwang (despite being suggested by the sat nav).
