General Terms and Conditions for Hotel Stays at

1 SCOPE OF APPLICATION
1.1 These terms and conditions apply to contracts for the rental provision of hotel rooms for accommodation, as well as all additional services and deliveries provided by the hotel in this context (hotel accommodation contract). The term “hotel accommodation contract” includes and replaces the following terms: accommodation contract, guest accommodation contract, hotel contract, hotel room contract.
1.2 Subletting or re-letting the provided rooms or their use for purposes other than accommodation requires the prior consent of the hotel in text form. Section 540 (1) sentence 2 of the German Civil Code (BGB) is waived insofar as the customer is not a consumer within the meaning of Section 13 BGB.
1.3 The customer’s general terms and conditions shall only apply if expressly agreed in advance in text form.
2 CONCLUSION OF CONTRACT, PARTIES, LIMITATION PERIOD
2.1 The contractual parties are the hotel and the customer. The contract is concluded upon the hotel’s acceptance of the customer’s request. The hotel is free to confirm the room booking in text form.
2.2 All claims against the hotel shall generally become time-barred one year after the statutory commencement of the limitation period.
This does not apply to claims for damages or other claims insofar as the latter are based on intentional or grossly negligent breaches of duty by the hotel.
3 SERVICES, PRICES, PAYMENT, SET-OFF
3.1 The hotel is obligated to keep the rooms booked by the customer available and to provide the agreed services.
3.2 The customer is obligated to pay the agreed or applicable prices for the room rental and any additional services used. This also applies to services commissioned by the customer directly or via the hotel and provided by third parties and advanced by the hotel.
3.3 The agreed prices include all taxes and local charges applicable at the time of contract conclusion. Not included are local charges payable by the guest under municipal law, such as visitor’s tax.
In the event of changes to VAT or the introduction, modification, or abolition of local charges after contract conclusion, prices will be adjusted accordingly.
In the case of contracts with consumers, this applies only if the period between contract conclusion and fulfillment exceeds four months.
3.4 The hotel may make its consent to a subsequent reduction in the number of booked rooms, the hotel’s services, or the duration of the customer’s stay dependent on an appropriate increase in the price for the rooms and/or other services.
3.5 Hotel invoices are due immediately upon receipt without deduction. If payment by invoice has been agreed, payment must be made within ten days of receipt without deduction unless otherwise agreed.
3.6 The hotel is entitled to request an appropriate advance payment or security, for example in the form of a credit card guarantee, upon contract conclusion. The amount and payment dates may be agreed in text form. Statutory provisions remain unaffected. In the event of late payment by the customer, statutory provisions shall apply.
3.7 In justified cases, such as payment arrears of the customer or an extension of the scope of the contract, the hotel is entitled, even after conclusion of the contract and up to the beginning of the stay, to request an advance payment or security within the meaning of Section 3.6 above or to increase the advance payment or security agreed in the contract up to the full agreed remuneration.
3.8 The hotel is also entitled to request an appropriate advance payment or security at the beginning and during the stay for existing and future claims arising from the contract, insofar as such has not already been provided pursuant to Section 3.6 and/or Section 3.7 above.
3.9 The customer may only offset or set off a claim against the hotel with an undisputed or legally binding claim.
3.10 The customer agrees that invoices may be transmitted electronically.
4 CUSTOMER CANCELLATION (WITHDRAWAL, CANCELLATION) / NON-USE OF HOTEL SERVICES (NO SHOW)
4.1 A withdrawal by the customer from the contract concluded with the hotel is only possible if a right of withdrawal has been expressly agreed in the contract, if a statutory right of withdrawal exists, or if the hotel expressly agrees to the cancellation of the contract.
4.2 If a date for free withdrawal from the contract has been agreed between the hotel and the customer, the customer may withdraw from the contract up to that date without triggering payment or compensation claims by the hotel.
4.3 If no right of withdrawal has been agreed or has already expired, and no statutory right of withdrawal or termination exists and the hotel does not agree to a cancellation, the hotel retains the right to the agreed remuneration despite non-use of the service. The hotel must offset income from re-letting the rooms and saved expenses.
If the rooms are not re-let, the hotel may apply a lump-sum deduction for saved expenses. In this case, the customer is obliged to pay 90% of the contractually agreed price for overnight stays with or without breakfast as well as for package arrangements with third-party services, 70% for half-board arrangements, and 60% for full-board arrangements. The customer is free to prove that the above claim did not arise or did not arise in the required amount.
5 HOTEL WITHDRAWAL
5.1 If it has been agreed that the customer may withdraw from the contract free of charge within a certain period, the hotel is also entitled to withdraw from the contract during this period if there are requests from other customers for the contractually booked rooms and the customer does not waive their right of withdrawal upon inquiry by the hotel within a reasonable period. This applies accordingly if an option has been granted.
5.2 If an advance payment or security agreed or requested in accordance with Sections 3.6 and/or 3.7 is not provided even after expiry of a reasonable grace period set by the hotel, the hotel is also entitled to withdraw from the contract.
5.3 Furthermore, the hotel is entitled to withdraw from the contract for objectively justified reasons, in particular if
– force majeure or other circumstances beyond the hotel’s control make fulfillment of the contract impossible;
– rooms or premises are culpably booked under misleading or false statements or concealment of essential facts; essential facts may include the identity of the customer, their ability to pay, or the purpose of the stay;
– the hotel has reasonable grounds to believe that the use of the service may jeopardize the smooth operation, security, or public reputation of the hotel, without this being attributable to the hotel’s sphere of control;
– the purpose or occasion of the stay is unlawful;
– there is a violation of Section 1.2 above.
5.4 A justified withdrawal by the hotel does not give rise to any claim for damages by the customer.
6 ROOM PROVISION, HANDOVER, AND RETURN
6.1 The customer does not acquire a claim to the provision of specific rooms unless this has been expressly agreed in text form.
6.2 Booked rooms are available to the customer from 3:00 PM on the agreed day of arrival. The customer is not entitled to earlier availability.
6.3 On the agreed day of departure, the rooms must be vacated and made available to the hotel no later than 12:00 PM. After that, the hotel may charge 50% of the full accommodation rate for use beyond the contract until 6:00 PM, and 90% after 6:00 PM. This does not establish contractual claims on the part of the customer. The customer is free to prove that the hotel has incurred no or significantly lower compensation.
7 LIABILITY OF THE HOTEL
7.1 The hotel is liable for damages for which it is responsible arising from injury to life, body, or health. It is also liable for other damages based on intentional or grossly negligent breaches of duty or on the intentional or negligent breach of typical contractual obligations. Typical contractual obligations are those that enable the proper execution of the contract and on whose fulfillment the customer relies and may rely. The breach of duty by a legal representative or vicarious agent is equivalent to that of the hotel. Further claims for damages are excluded unless otherwise provided in this Section 7. In the event of disruptions or defects in the hotel’s services, the hotel will endeavor to remedy them upon knowledge or immediate complaint by the customer. The customer is obliged to contribute what is reasonable to remedy the disruption and minimize possible damage.
7.2 The hotel is liable for items brought in by the customer in accordance with statutory provisions. The hotel recommends the use of the hotel or room safe. If the customer wishes to bring in money, securities, or valuables worth more than €800 or other items worth more than €3,500, a separate safekeeping agreement with the hotel is required.
7.3 If a parking space in the hotel garage or on the hotel parking lot is provided to the customer, even for a fee, this does not constitute a safekeeping contract. The hotel is only liable for loss or damage to vehicles parked or maneuvered on hotel property and their contents in accordance with Section 7.1 above.
7.4 Wake-up calls are carried out by the hotel with the utmost care. Messages for customers are handled with care. The hotel may, upon prior agreement, accept, store, and—upon request and for a fee—forward mail and goods shipments. Liability is limited in accordance with Section 7.1 above.
8 FINAL PROVISIONS
8.1 Amendments and supplements to the contract, the acceptance of the application, or these general terms and conditions should be made in text form. Unilateral amendments or supplements are invalid.
8.2 Place of performance and payment and exclusive place of jurisdiction—also for disputes relating to checks and bills of exchange—is Ostseebad Sellin, Wilhelmstraße 34, in commercial transactions.
If the customer meets the requirements of Section 38 (2) of the German Code of Civil Procedure (ZPO) and has no general place of jurisdiction in Germany, Ostseebad Sellin, Wilhelmstraße 34 shall be the place of jurisdiction.
8.3 German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
8.4 In accordance with statutory obligations, the hotel points out that the European Union has established an online platform for the out-of-court resolution of consumer disputes (“ODR platform”): http://ec.europa.eu/consumers/odr/
However, the hotel does not participate in dispute resolution proceedings before consumer arbitration boards.

Contractual relationships arise directly between Rugia Touristik GmbH (hereinafter referred to as the “Hotel”) and persons/companies making bookings/reservations. The following conditions apply to the booking and handling of banquet agreements:
1 Scope
1.1 These terms and conditions apply to contracts for the rental of conference, banquet, and event rooms of the hotel for the organization of events such as banquets, seminars, weddings, conferences, concerts, performances, and presentations, as well as all related additional services and deliveries of the hotel.
1.2 Terms and conditions of the guest shall only apply if expressly agreed in writing.
2 General Conditions
2.1 The booking of hotel rooms is only valid in connection with an event. If a booked event is canceled, the hotel reserves the right to release the corresponding rooms.
2.2 We kindly ask that no personal or additional decorations be installed in or on the building without prior consultation with the hotel, as this may be refused.
2.3 Without prior consultation with the hotel, the use of sound systems via external media or playback devices, as well as projectors or similar equipment, may be prohibited. If approval is granted, the organizer must obtain the necessary GEMA license and present it to the hotel prior to the event. All associated costs shall be borne by the organizer. Musicians or entertainers engaged by the organizer are subject to the same regulations.
2.4 In the interest of other guests, we kindly ask that children attending the event be supervised.
3 Liability for Damages
3.1 The organizer is obliged to bear the cost of any damages of any kind caused by the event or its participants.
3.2 The hotel assumes no liability for coats, cameras, or similar items.
3.3 The organizer is solely responsible for compliance with youth protection laws.
4 Services, Prices, Payment, Set-Off
4.1 The hotel is obligated to provide the services ordered by the organizer and confirmed by the hotel.
4.2 The organizer is obligated to pay the agreed prices for these services. This also applies to services and expenses incurred in connection with the event involving third parties.
4.3 The agreed prices include the applicable statutory VAT. If VAT increases due to legal regulations, the hotel is entitled to adjust the agreed prices accordingly without prior consent of the guest. If the period between contract conclusion and fulfillment exceeds four months and the general price charged by the hotel for such services increases, the hotel may increase the agreed price by up to 10%.
4.4 Hotel invoices without a due date are payable within seven days of the invoice date without deduction.
4.5 No later than four weeks before the event, the organizer must transfer a deposit of 50% of the expected event costs to the hotel’s business account, stating the event date and name.
4.6 For events extending beyond 3:00 AM, the hotel reserves the right to charge a surcharge for personnel costs.
5 Cancellation / Changes to Rooms
5.1 Free cancellation of the event is possible up to 4 months before the event date. Thereafter, 50% of the booked package (room rental) will be charged. Cancellation up to 1 month before the event will incur 80%, and up to 1 week before the event 100% of the booked package.
5.2 Any changes (e.g., food, number of staff) must be communicated no later than 10 days before use.
5.3 Up to 1 week before the event, 10% of the total number of participants may be canceled free of charge. Up to 2 days before the event, 2 persons may be canceled free of charge. Later cancellations will be charged at 80% of the package per person.
5.4 If a withdrawal from the contract or requested changes are not communicated in due time, the hotel will charge for ordered but unused perishable goods. These will be made available to the organizer on the event day, without any entitlement to quality claims due to timing differences.
5.5 In cases of force majeure, the hotel may be released from its obligations or terminate the event.
5.6 This also applies in cases of improper behavior not in keeping with the character of the hotel or harassment of other guests not belonging to the organizer.
5.7 Changes to the contractually agreed number of participants requested by the organizer may affect room allocation and do not necessarily need to be communicated in advance.
6 Liability
Liability is assumed only for errors caused by the hotel.
7 Final Provisions
7.1 Amendments or supplements to the contract, the acceptance of the application, or these terms and conditions should be made in writing. Unilateral changes by the customer are invalid.
7.2 Place of performance and payment is the registered office of the hotel.
7.3 Exclusive place of jurisdiction—also for disputes relating to checks and bills of exchange—is the registered office of the hotel, provided the customer is a business entity. If a contracting party meets the requirements of Section 38 (2) ZPO and has no general place of jurisdiction in Germany, the registered office of the hotel shall be the place of jurisdiction.
7.4 German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules is excluded.
7.5 Should individual provisions of these terms and conditions for events be or become invalid, the validity of the remaining provisions shall not be affected. Otherwise, statutory provisions shall apply.

3.7 In justified cases, such as payment arrears of the customer or an extension of the scope of the contract, the hotel is entitled, even after conclusion of the contract and up to the beginning of the stay, to request an advance payment or security within the meaning of Section 3.6 above or to increase the advance payment or security agreed in the contract up to the full agreed remuneration.
3.8 The hotel is also entitled to request an appropriate advance payment or security at the beginning and during the stay for existing and future claims arising from the contract, insofar as such has not already been provided pursuant to Section 3.6 and/or Section 3.7 above.
3.9 The customer may only offset or set off a claim against the hotel with an undisputed or legally binding claim.
3.10 The customer agrees that invoices may be transmitted electronically.
4 CUSTOMER CANCELLATION (WITHDRAWAL, CANCELLATION) / NON-USE OF HOTEL SERVICES (NO SHOW)
4.1 A withdrawal by the customer from the contract concluded with the hotel is only possible if a right of withdrawal has been expressly agreed in the contract, if a statutory right of withdrawal exists, or if the hotel expressly agrees to the cancellation of the contract.
4.2 If a date for free withdrawal from the contract has been agreed between the hotel and the customer, the customer may withdraw from the contract up to that date without triggering payment or compensation claims by the hotel.
4.3 If no right of withdrawal has been agreed or has already expired, and no statutory right of withdrawal or termination exists and the hotel does not agree to a cancellation, the hotel retains the right to the agreed remuneration despite non-use of the service. The hotel must offset income from re-letting the rooms and saved expenses.
If the rooms are not re-let, the hotel may apply a lump-sum deduction for saved expenses. In this case, the customer is obliged to pay 90% of the contractually agreed price for overnight stays with or without breakfast as well as for package arrangements with third-party services, 70% for half-board arrangements, and 60% for full-board arrangements. The customer is free to prove that the above claim did not arise or did not arise in the required amount.
5 HOTEL WITHDRAWAL
5.1 If it has been agreed that the customer may withdraw from the contract free of charge within a certain period, the hotel is also entitled to withdraw from the contract during this period if there are requests from other customers for the contractually booked rooms and the customer does not waive their right of withdrawal upon inquiry by the hotel within a reasonable period. This applies accordingly if an option has been granted.
5.2 If an advance payment or security agreed or requested in accordance with Sections 3.6 and/or 3.7 is not provided even after expiry of a reasonable grace period set by the hotel, the hotel is also entitled to withdraw from the contract.
5.3 Furthermore, the hotel is entitled to withdraw from the contract for objectively justified reasons, in particular if
– force majeure or other circumstances beyond the hotel’s control make fulfillment of the contract impossible;
– rooms or premises are culpably booked under misleading or false statements or concealment of essential facts; essential facts may include the identity of the customer, their ability to pay, or the purpose of the stay;
– the hotel has reasonable grounds to believe that the use of the service may jeopardize the smooth operation, security, or public reputation of the hotel, without this being attributable to the hotel’s sphere of control;
– the purpose or occasion of the stay is unlawful;
– there is a violation of Section 1.2 above.
5.4 A justified withdrawal by the hotel does not give rise to any claim for damages by the customer.
6 ROOM PROVISION, HANDOVER, AND RETURN
6.1 The customer does not acquire a claim to the provision of specific rooms unless this has been expressly agreed in text form.
6.2 Booked rooms are available to the customer from 3:00 PM on the agreed day of arrival. The customer is not entitled to earlier availability.
6.3 On the agreed day of departure, the rooms must be vacated and made available to the hotel no later than 12:00 PM. After that, the hotel may charge 50% of the full accommodation rate for use beyond the contract until 6:00 PM, and 90% after 6:00 PM. This does not establish contractual claims on the part of the customer. The customer is free to prove that the hotel has incurred no or significantly lower compensation.
7 LIABILITY OF THE HOTEL
7.1 The hotel is liable for damages for which it is responsible arising from injury to life, body, or health. It is also liable for other damages based on intentional or grossly negligent breaches of duty or on the intentional or negligent breach of typical contractual obligations. Typical contractual obligations are those that enable the proper execution of the contract and on whose fulfillment the customer relies and may rely. The breach of duty by a legal representative or vicarious agent is equivalent to that of the hotel. Further claims for damages are excluded unless otherwise provided in this Section 7. In the event of disruptions or defects in the hotel’s services, the hotel will endeavor to remedy them upon knowledge or immediate complaint by the customer. The customer is obliged to contribute what is reasonable to remedy the disruption and minimize possible damage.
7.2 The hotel is liable for items brought in by the customer in accordance with statutory provisions. The hotel recommends the use of the hotel or room safe. If the customer wishes to bring in money, securities, or valuables worth more than €800 or other items worth more than €3,500, a separate safekeeping agreement with the hotel is required.
7.3 If a parking space in the hotel garage or on the hotel parking lot is provided to the customer, even for a fee, this does not constitute a safekeeping contract. The hotel is only liable for loss or damage to vehicles parked or maneuvered on hotel property and their contents in accordance with Section 7.1 above.
7.4 Wake-up calls are carried out by the hotel with the utmost care. Messages for customers are handled with care. The hotel may, upon prior agreement, accept, store, and—upon request and for a fee—forward mail and goods shipments. Liability is limited in accordance with Section 7.1 above.
8 FINAL PROVISIONS
8.1 Amendments and supplements to the contract, the acceptance of the application, or these general terms and conditions should be made in text form. Unilateral amendments or supplements are invalid.
8.2 Place of performance and payment and exclusive place of jurisdiction—also for disputes relating to checks and bills of exchange—is Ostseebad Sellin, Wilhelmstraße 34, in commercial transactions.
If the customer meets the requirements of Section 38 (2) of the German Code of Civil Procedure (ZPO) and has no general place of jurisdiction in Germany, Ostseebad Sellin, Wilhelmstraße 34 shall be the place of jurisdiction.
8.3 German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
8.4 In accordance with statutory obligations, the hotel points out that the European Union has established an online platform for the out-of-court resolution of consumer disputes (“ODR platform”): http://ec.europa.eu/consumers/odr/
However, the hotel does not participate in dispute resolution proceedings before consumer arbitration boards.

Contractual relationships arise directly between Rugia Touristik GmbH (hereinafter referred to as the “Hotel”) and persons/companies making bookings/reservations. The following conditions apply to the booking and handling of banquet agreements:
1 Scope
1.1 These terms and conditions apply to contracts for the rental of conference, banquet, and event rooms of the hotel for the organization of events such as banquets, seminars, weddings, conferences, concerts, performances, and presentations, as well as all related additional services and deliveries of the hotel.
1.2 Terms and conditions of the guest shall only apply if expressly agreed in writing.
2 General Conditions
2.1 The booking of hotel rooms is only valid in connection with an event. If a booked event is canceled, the hotel reserves the right to release the corresponding rooms.
2.2 We kindly ask that no personal or additional decorations be installed in or on the building without prior consultation with the hotel, as this may be refused.
2.3 Without prior consultation with the hotel, the use of sound systems via external media or playback devices, as well as projectors or similar equipment, may be prohibited. If approval is granted, the organizer must obtain the necessary GEMA license and present it to the hotel prior to the event. All associated costs shall be borne by the organizer. Musicians or entertainers engaged by the organizer are subject to the same regulations.
2.4 In the interest of other guests, we kindly ask that children attending the event be supervised.
3 Liability for Damages
3.1 The organizer is obliged to bear the cost of any damages of any kind caused by the event or its participants.
3.2 The hotel assumes no liability for coats, cameras, or similar items.
3.3 The organizer is solely responsible for compliance with youth protection laws.
4 Services, Prices, Payment, Set-Off
4.1 The hotel is obligated to provide the services ordered by the organizer and confirmed by the hotel.
4.2 The organizer is obligated to pay the agreed prices for these services. This also applies to services and expenses incurred in connection with the event involving third parties.
4.3 The agreed prices include the applicable statutory VAT. If VAT increases due to legal regulations, the hotel is entitled to adjust the agreed prices accordingly without prior consent of the guest. If the period between contract conclusion and fulfillment exceeds four months and the general price charged by the hotel for such services increases, the hotel may increase the agreed price by up to 10%.
4.4 Hotel invoices without a due date are payable within seven days of the invoice date without deduction.
4.5 No later than four weeks before the event, the organizer must transfer a deposit of 50% of the expected event costs to the hotel’s business account, stating the event date and name.
4.6 For events extending beyond 3:00 AM, the hotel reserves the right to charge a surcharge for personnel costs.
5 Cancellation / Changes to Rooms
5.1 Free cancellation of the event is possible up to 4 months before the event date. Thereafter, 50% of the booked package (room rental) will be charged. Cancellation up to 1 month before the event will incur 80%, and up to 1 week before the event 100% of the booked package.
5.2 Any changes (e.g., food, number of staff) must be communicated no later than 10 days before use.
5.3 Up to 1 week before the event, 10% of the total number of participants may be canceled free of charge. Up to 2 days before the event, 2 persons may be canceled free of charge. Later cancellations will be charged at 80% of the package per person.
5.4 If a withdrawal from the contract or requested changes are not communicated in due time, the hotel will charge for ordered but unused perishable goods. These will be made available to the organizer on the event day, without any entitlement to quality claims due to timing differences.
5.5 In cases of force majeure, the hotel may be released from its obligations or terminate the event.
5.6 This also applies in cases of improper behavior not in keeping with the character of the hotel or harassment of other guests not belonging to the organizer.
5.7 Changes to the contractually agreed number of participants requested by the organizer may affect room allocation and do not necessarily need to be communicated in advance.
6 Liability
Liability is assumed only for errors caused by the hotel.
7 Final Provisions
7.1 Amendments or supplements to the contract, the acceptance of the application, or these terms and conditions should be made in writing. Unilateral changes by the customer are invalid.
7.2 Place of performance and payment is the registered office of the hotel.
7.3 Exclusive place of jurisdiction—also for disputes relating to checks and bills of exchange—is the registered office of the hotel, provided the customer is a business entity. If a contracting party meets the requirements of Section 38 (2) ZPO and has no general place of jurisdiction in Germany, the registered office of the hotel shall be the place of jurisdiction.
7.4 German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules is excluded.
7.5 Should individual provisions of these terms and conditions for events be or become invalid, the validity of the remaining provisions shall not be affected. Otherwise, statutory provisions shall apply.

Arrival with car
To the island of Rügen:
Take the A20 highway toward Rostock or Stralsund.
On the island of Rügen:
After crossing the Rügen Bridge, follow the B96 toward Bergen.
Shortly before reaching Bergen, take the right exit onto the B196 toward Göhren.
This road will take you directly to Sellin.
Arrival with train
If you are arriving by train, we are happy to offer a pickup service from the main train station in Binz. Please inform us of your exact arrival time at least two days prior to your arrival.
There are also direct train connections to the seaside resort of Binz.

The nearest commercial airport is Rostock-Laage Airport.
